These Terms and Conditions ("Terms") govern your access to and use of the website www.asktranslator.com, the AskTranslator web application, and the services provided through them, including translation, optical character recognition (OCR), document processing, and AI-generated language outputs (collectively, the "Service" or "AskTranslator").

The Service is owned and operated by Xieta AI Private Limited, a company incorporated in India, having its registered office at Plot No. 25, 1st Floor, Industrial Area Phase-I, Chandigarh, India – 160002 ("Company", "Xieta", "we", "us", or "our").

Please read these Terms carefully. By clicking "I Agree", checking an acceptance box, completing account registration, making a payment for document processing, uploading a document, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Website Disclaimer.

If you do not agree, you must not use the Service.


1. Eligibility and Account

1.1 Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under Indian law to use the Service.

By creating an account or using the Service, you represent that:

(a) you are at least 18 years old;

(b) you have the legal capacity to enter into binding agreements;

(c) the information you provide to us is true, accurate, current, and complete; and

(d) you will use the Service only in accordance with these Terms and applicable law.

The Service is not intended for use by children or by persons under 18 years of age. If we become aware that an account has been created by a person under 18, we may suspend or terminate the account and delete associated personal data, except where retention is required by law.

1.2 No child-directed use

AskTranslator is not designed for, directed at, or intended to be used by children.

You must not knowingly use the Service for a use case directed specifically at children or upload documents primarily concerning a child or minor unless you have lawful authority to do so and such processing is not prohibited by applicable law.

If our systems or personnel identify a document as explicitly involving child or minor personal data, we may refuse processing, delete the document, restrict access, or automatically apply Private Mode as described in these Terms and our Privacy Policy.

You remain responsible for ensuring that you have the lawful right and authority to upload and process any document through the Service.

1.3 Account registration

To access certain features, you may need to create an account. You agree to provide accurate, complete, and current information and to keep it updated.

1.4 Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us immediately at support@xieta.ai if you suspect unauthorised access, misuse of your account, or any security breach.

We are not responsible for loss or damage arising from your failure to keep your account secure.


2. Description of the Service

2.1 Nature of the Service

AskTranslator is an online translation, OCR, and AI-assisted language-processing service.

The Service may allow users to upload documents, images, scanned files, or text and receive:

(a) translated text or translated documents;

(b) extracted and digitised text from images or scans;

(c) summaries or other language-processing outputs; and/or

(d) other AI-generated outputs made available through the Service from time to time.

Outputs are generated using automated systems and artificial intelligence models, including third-party AI providers. Outputs are probabilistic and may contain errors, omissions, mistranslations, formatting mistakes, OCR errors, hallucinations, or unintended meanings.

You must review and verify all outputs before using or relying on them.

2.2 Not certified or professional translation

Unless we separately and expressly confirm otherwise in writing, AskTranslator does not provide certified, notarised, sworn, attested, or officially recognised translations.

Outputs are not a substitute for professional legal, medical, financial, immigration, academic, governmental, or other specialist advice or certification.

2.3 Geographic scope

The Service is primarily intended for users in India and operates under Indian law. It may be accessible from other jurisdictions, but we do not represent that the Service is appropriate, lawful, or available in every jurisdiction.

Users accessing the Service from outside India do so on their own initiative and are responsible for compliance with local law.

2.4 Service changes

We may modify, suspend, restrict, discontinue, or change the Service or any part of it from time to time for operational, security, legal, commercial, or technical reasons.

We may also impose, change, or remove usage limits, rate limits, quotas, file-size limits, model availability, pricing, or feature access.

Where a change materially affects paid services already purchased by you, we will act reasonably and provide notice where practicable.

2.5 Force majeure

We will not be liable for delay or failure caused by circumstances beyond our reasonable control, including natural disasters, government orders, internet or telecommunications failures, cyberattacks, third-party provider failures, power outages, epidemics, pandemics, labour disruptions, or other events that could not reasonably be prevented.

If a Force Majeure Event materially prevents delivery of a paid service for more than 30 days, either party may terminate the affected paid arrangement, and we will provide a refund or credit for any undelivered prepaid portion, where applicable.


3. User Content and Uploaded Materials

3.1 User Content

"User Content" means any document, text, image, scan, file, data, instruction, or other material you upload, submit, or make available through the Service.

3.2 Ownership

You retain ownership of your User Content. We do not claim ownership of your uploaded documents.

3.3 Licence for providing the Service

By uploading User Content, you grant us a limited, worldwide, non-exclusive, royalty-free licence to host, upload, download, transmit, process, reproduce, convert, display, and use your User Content solely as necessary to:

(a) provide the Service requested by you;

(b) generate translations, OCR outputs, summaries, or other requested outputs;

(c) provide support, troubleshooting, security, abuse-prevention, billing, and legal-compliance functions;

(d) store outputs during the applicable retention period described in our Privacy Policy; and

(e) operate and improve the Service using non-identifying metadata, aggregated analytics, and anonymised data, subject to the restrictions below.

This licence ends when the relevant User Content is deleted from our controlled systems, except for limited metadata, records, and anonymised or aggregated data that we may retain as described in these Terms and our Privacy Policy.

3.4 Restrictions on model improvement, review, and datasets

We do not use identifiable uploaded documents, identifiable OCR text, or identifiable translation outputs for model training or fine-tuning.

For standard-mode documents only, we may use identifiable content for internal review, audit, validation, testing, benchmarking, or quality improvement only where:

(a) the document is processed in standard mode;

(b) the document is not processed under Auto-delete Mode, Private Mode, or System-Detected Private Mode;

(c) the document is not a child/minor-related document, Aadhaar/government-ID document, health record, financial record, legal case file, intimate-content document, or other sensitive/high-risk document; and

(d) a coupon, promotional credit, offer, or similar benefit clearly discloses before use that applying it permits such internal use, and you affirmatively choose to apply that coupon, promotional credit, offer, or benefit.

Where such disclosure applies and you choose to use the coupon, promotional credit, offer, or benefit, the affected standard-mode document and related outputs may be used for the disclosed internal review, audit, validation, testing, benchmarking, or quality-improvement purposes.

Documents processed under Auto-delete Mode, Private Mode, or System-Detected Private Mode are excluded from:

(a) routine manual quality review;

(b) model training, fine-tuning, testing, validation, or quality-improvement datasets;

(c) external datasets, corpora, or translation-memory products;

(d) commercial licensing of document-derived content; and

(e) product-improvement uses involving identifiable content.

For standard-mode documents not covered by a clear coupon or promotional disclosure, we may use anonymised or aggregated information for analytics, quality measurement, service improvement, benchmarking, research, and product development, provided that no individual or specific uploaded document can reasonably be identified.

"Anonymised" means processed in a manner that prevents identification of the individual described in, or associated with, the content using reasonably available means. Pseudonymised information does not qualify as anonymised if re-identification is reasonably possible.

3.5 Your responsibility for User Content

You are solely responsible for User Content you upload and for ensuring that you have the legal right and authority to upload and process it.

You represent and warrant that:

(a) you own or have all rights, licences, permissions, authorisations, and consents necessary to upload the User Content and use the Service;

(b) your User Content does not infringe any intellectual property, privacy, confidentiality, contractual, data-protection, defamation, or other right of any person;

(c) you have lawful authority to provide any third-party personal data contained in your User Content;

(d) your User Content does not contain malware, viruses, harmful code, or unlawful content;

(e) your use of the Service complies with applicable law; and

(f) you will not upload documents for which processing through an automated translation/OCR service is prohibited by law, contract, confidentiality obligation, or official restriction.

Where you determine the purpose and means of processing third-party personal data contained in your uploads, you may be the data fiduciary, controller, or equivalent responsible party for such data. We process such data on your instruction to provide the Service, while remaining responsible for our own legal obligations relating to security, processor management, consumer protection, and compliance.

3.6 Prohibited content

You must not upload or submit User Content that:

(a) is unlawful, defamatory, obscene, pornographic, hateful, threatening, violent, harassing, or otherwise objectionable;

(b) promotes illegal activity, terrorism, exploitation, abuse, or serious harm;

(c) contains child sexual abuse material or sexual content involving minors;

(d) contains non-consensual intimate images, deepfakes, morphed images, or material violating privacy or dignity;

(e) contains malware, spyware, ransomware, malicious code, or phishing material;

(f) infringes intellectual property, confidentiality, privacy, publicity, or data-protection rights;

(g) contains classified, state-secret, officially restricted, or government-confidential material without appropriate authorisation;

(h) is intended to create false, forged, misleading, or fraudulent documents or records;

(i) is intended to impersonate, deceive, defraud, or misrepresent the identity, authority, or status of any person or entity; or

(j) violates any applicable law or regulation.

We may refuse, remove, restrict, delete, or disable access to any User Content that we reasonably believe violates these Terms, our policies, or applicable law.


4. Auto-delete Mode, Private Mode, and Retention

4.1 Auto-delete Mode

Auto-delete Mode is an account-level setting that allows users to have documents uploaded while the mode is active deleted within 72 hours.

When Auto-delete Mode is active, uploaded files and processed copies for documents uploaded during that period are scheduled for deletion within 72 hours.

You may turn Auto-delete Mode on or off through your account settings where available. Turning Auto-delete Mode off applies only to future uploads. Documents already uploaded while Auto-delete Mode was active will remain scheduled for deletion and cannot be moved back to standard retention. Similarly, turning Auto-delete Mode on applies only to future uploads and does not affect documents uploaded before it was turned on.

4.2 Private Mode

Private Mode is a per-document setting that applies enhanced deletion and processing restrictions to a specific document.

You may select Private Mode for a document where available. Once Private Mode is applied, the document and its processed copies are scheduled for deletion within 72 hours and cannot be downgraded to standard retention.

4.3 System-Detected Private Mode

Our backend systems may automatically apply Private Mode where they detect that the nature of a document appears to require shorter retention or stronger safeguards.

Documents that may trigger AI-based or automated System-Detected Private Mode may include, without limitation:

  • Documents involving minors: birth certificates, school mark sheets, report cards, school leaving certificates, and legal or medical files explicitly naming a child or person under 18.
  • Data of persons with disabilities: official disability certificates, medical evaluations declaring legal incapacitation, and court-appointed guardianship orders.
  • Core financial and taxation identifiers: bank statements, account statements, e-statements, transaction statements, account ledgers, credit card statements, detailed CIBIL/credit history reports, PAN cards, or visible PAN numbers. Any visible bank/account statement page is sensitive by document type, including continuation pages, later pages, and pages showing transaction/account context even when no card or ID number is transcribed.
  • Regulated national IDs and official ID-linked forms: unmasked Aadhaar cards, standalone Aadhaar numbers, physical passports, Aadhaar enrollment forms, Aadhaar declaration forms, Aadhaar update/correction forms, Aadhaar e-KYC certificates, UIDAI/Aadhaar-linked KYC forms, and bank/customer/controlling-person KYC forms. These official forms are sensitive by document type when visibly present, even if the model does not explicitly read the Aadhaar/PAN number.
  • Health and medical records: diagnostic pathology lab reports, clinical prescriptions, psychiatric or mental-health evaluations, and hospital discharge summaries.
  • Statutorily sealed criminal or civil files: Family Court documents such as divorce petitions, alimony agreements, or child custody filings, and criminal records involving sexual offences or the POCSO Act. For criminal files, flag only when visible text indicates a sexual offence, rape/sexual assault, victim identity protection, in-camera proceeding, POCSO, child sexual abuse, or similar restricted category; do not flag ordinary FIR/police/criminal records.
  • Intimate or explicit content: nudity, intimate photographs, sexually explicit visual content, or highly graphic sexual text.

If a document is placed in System-Detected Private Mode, the user cannot override, cancel, or downgrade that mode.

Documents placed in System-Detected Private Mode are scheduled for deletion within 72 hours from job completion, failed processing status, or termination of processing, as applicable.

4.4 What is deleted in 72-hour modes

For Auto-delete Mode, Private Mode, and System-Detected Private Mode, deletion applies to uploaded files and processed copies held in Xieta-controlled active systems, including:

(a) source files uploaded by you;

(b) OCR text;

(c) translated text;

(d) translated files;

(e) summaries generated from the document;

(f) previews and thumbnails;

(g) intermediate conversion files;

(h) temporary processing files;

(i) document-content caches; and

(j) other document-content copies.

Unless a shorter period applies, deletion under Auto-delete Mode, Private Mode, and System-Detected Private Mode is scheduled within 72 hours from job completion, failed processing status, or termination of processing, as applicable.

After deletion, you will no longer be able to access the uploaded document or its outputs through the Service. You are responsible for downloading and saving any output you wish to keep before expiry.

We may retain limited metadata, job summaries, transaction records, payment records, access logs, security logs, processing metadata, audit records, and legal-compliance records as described in Section 4.5 and our Privacy Policy.

4.5 Metadata, summaries, logs, and legal records

After document-content deletion, we may retain limited metadata, job summaries, transaction records, payment records, access logs, security logs, processing metadata, audit records, and legal-compliance records where necessary for security, support, billing, fraud prevention, dispute resolution, legal compliance, or service administration.

We do not intentionally write document contents into analytics, monitoring tools, or ordinary operational logs. Metadata and logs are access-controlled.

4.6 Standard retention

Documents processed in standard mode may be retained for up to 90 days from job completion, unless required to be retained or deleted sooner by law, deleted earlier by you, or moved into Private Mode.

Turning Auto-delete Mode on applies only to future uploads and does not affect documents uploaded before Auto-delete Mode was turned on.

AskTranslator is not a document storage, backup, or archiving service. You should not rely on the Service to preserve original documents or outputs.

5. Acceptable Use

5.1 General obligations

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You must not:

(a) use the Service in violation of applicable law;

(b) interfere with or disrupt the Service;

(c) attempt to gain unauthorised access to the Service, user accounts, systems, networks, models, APIs, or infrastructure;

(d) reverse engineer, scrape, crawl, decompile, extract, or replicate the Service, except where expressly permitted by law;

(e) bypass usage limits, security controls, payment controls, retention settings, or access restrictions;

(f) use the Service to generate spam, fraud, phishing, forged documents, impersonation material, or misleading information;

(g) use the Service to process documents for which you lack authority;

(h) upload biometric data of third parties without lawful authority and consent;

(i) use outputs to impersonate, deceive, defraud, or misrepresent any person or entity;

(j) use the Service for high-risk, life-critical, or safety-critical purposes; or

(k) use the Service in a manner that may harm Xieta, other users, third parties, or the public; or

(l) use the Service to process documents that are illegal, infringing, confidential, officially restricted, or otherwise restricted by law, contract, or confidentiality obligation.

5.2 High-risk use

The Service is not designed for high-risk uses where an error could cause death, personal injury, severe financial loss, legal prejudice, or serious harm.

You must not rely on outputs without professional review in contexts such as:

(a) medical diagnosis or treatment;

(b) legal filings or legal advice;

(c) immigration, consular, court, regulatory, or government submissions;

(d) financial, tax, insurance, or investment decisions;

(e) critical infrastructure;

(f) law enforcement or employment decisions;

(g) academic certification or admissions decisions; or

(h) any other high-stakes context.

5.3 Enforcement

We may monitor, filter, refuse, suspend, restrict, delete, or report User Content or accounts where we reasonably believe there is misuse, legal risk, security risk, or violation of these Terms.

We may cooperate with law enforcement, regulators, courts, and government authorities where required or permitted by law.


6. Third-Party Services and AI Providers

6.1 Third-party providers

The Service may use configured third-party providers for hosting, storage, AI processing, language processing, communications, analytics, logging, payments, security, login, and support.

Your User Content and personal data may be processed by third-party providers as necessary to provide, secure, support, bill for, and improve the Service. Current provider categories, data-processing purposes, and provider-training safeguards are described in our Privacy Policy.

We may add, remove, replace, disable, or limit providers from time to time for product, operational, legal, security, availability, or commercial reasons.

6.2 Provider processing and third-party terms

We select provider plans, API configurations, and contractual settings intended to provide appropriate privacy, security, and business/API protections for the Service. However, third-party providers operate under their own service terms, data-processing terms, infrastructure, retention rules, and legal obligations. We do not control every aspect of external provider processing.

Your use of certain features may be subject to third-party terms. You agree to comply with any applicable third-party terms where relevant.


7. Intellectual Property

7.1 Our rights

All rights, title, and interest in and to the Service, including software, code, workflows, models, prompts, interfaces, designs, features, logos, trademarks, databases, know-how, documentation, and related intellectual property, are owned by or licensed to Xieta.

You do not acquire any ownership rights in the Service.

7.2 Limited licence to use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, internal, or business purposes.

7.3 Restrictions

You must not copy, sell, resell, license, sublicense, modify, distribute, reproduce, create derivative works from, or commercially exploit the Service except as expressly permitted by us in writing.

7.4 Outputs

Subject to your compliance with these Terms and payment of applicable fees, as between you and us, you may use the outputs generated from your User Content.

However:

(a) we do not guarantee that outputs are original, unique, protectable, or non-infringing;

(b) similar or identical inputs may produce similar or identical outputs for different users;

(c) outputs may require human review or professional certification before use; and

(d) you are responsible for your use of outputs.

7.5 Feedback

If you provide suggestions, ideas, corrections, or feedback about the Service, you permit us to use them without restriction, obligation, payment, attribution, or confidentiality, provided that we do not disclose your personal data except as described in our Privacy Policy.


8. Fees, Payments, Refunds, and Taxes

8.1 Fees

Certain features may be free, paid, usage-based, credit-based, promotional, or subscription-based.

Prices, limits, inclusions, and restrictions will be displayed on the Service or agreed separately.

8.2 Payments

You agree to pay applicable fees and authorise us or our payment processors to charge your selected payment method.

Payments may be processed by third-party payment gateways such as PayU or other providers.

8.3 Taxes

Fees may be exclusive of GST and other applicable taxes unless stated otherwise. Applicable taxes will be added as required by law.

8.4 Refunds

Unless otherwise stated, fees are ordinarily non-refundable once processing has begun.

However, this does not limit your rights under applicable law or your remedies for:

(a) a failed service;

(b) duplicate charge;

(c) non-delivery of a purchased service;

(d) a materially defective or materially misdescribed service; or

(e) any refund required by applicable law.

Dissatisfaction arising solely from the ordinary limitations of AI-generated or OCR-based output does not automatically entitle you to a refund if the service was delivered as described.

To request a refund, contact support@xieta.ai within 7 days of the relevant charge, with details of the transaction and issue or use support button in the app as listed against each document processing job in the "My Documents" section. Accepted refunds will ordinarily be processed within 5–7 business days, subject to payment gateway, banking, and regulatory processing timelines.

For Auto-delete Mode, Private Mode, or System-Detected Private Mode documents, please raise any refund, support, or quality issue as soon as possible and preferably before the 72-hour deletion period expires. After deletion, we may be unable to verify or investigate the issue because the document content and outputs may no longer be available.

8.5 Explicit purchase consent

Where required by law, we will record purchase consent through an explicit affirmative action, such as clicking a payment or confirmation button. We will not rely on pre-ticked boxes for paid purchases.

8.6 Promotions

We may offer free trials, coupons, credits, or promotional access. Promotional benefits may be subject to additional conditions, validity periods, usage limits, or withdrawal.

External promotional communications are controlled by your marketing preferences where applicable. We may still show coupons, credits, product notices, account messages, and service updates as in-app website notices within the logged-in Service interface. These in-app website notices are part of the Service experience and are not browser push, mobile push, email, SMS, WhatsApp, or phone communications unless separately stated and permitted.


9. Disclaimers

9.1 Service provided "as is"

The Service and all outputs are provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we disclaim all warranties, express, implied, statutory, or otherwise, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, title, uninterrupted availability, and error-free operation.

9.2 No accuracy guarantee

We do not warrant that translations, OCR outputs, summaries, or other outputs will be accurate, complete, current, suitable, legally valid, culturally appropriate, or accepted by any authority or third party.

Outputs may contain errors, omissions, hallucinations, bias, mistranslations, OCR mistakes, formatting issues, or unintended meanings.

9.3 User review required

You are solely responsible for reviewing, verifying, correcting, and validating all outputs before use.

You must obtain professional review where the output may affect legal, medical, financial, immigration, academic, employment, regulatory, governmental, or other important rights or obligations.

9.4 No storage guarantee

AskTranslator is not a document storage, archiving, or backup service. We do not guarantee ongoing availability of uploads or outputs beyond the retention periods described in our Privacy Policy.


10. Limitation of Liability

10.1 Exclusion of certain damages

To the maximum extent permitted by applicable law, Xieta, its directors, officers, employees, contractors, agents, affiliates, and successors will not be liable for:

(a) indirect, incidental, special, consequential, exemplary, or punitive damages;

(b) loss of profits, revenue, goodwill, data, business opportunity, or anticipated savings;

(c) business interruption;

(d) cost of substitute services;

(e) rejection of outputs by any authority, institution, court, employer, university, embassy, or third party;

(f) reliance on inaccurate, incomplete, or unsuitable outputs;

(g) third-party provider failures, outages, model limitations, or data handling; or

(h) deletion of documents or outputs in accordance with these Terms or our Privacy Policy.

10.2 Liability cap

To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Service, these Terms, the Privacy Policy, or the Website Disclaimer in any 12-month period will not exceed the lesser of:

(a) the total fees actually paid by you to us during the three months immediately preceding the event giving rise to the claim; or

(b) INR 10,000.

This is a cumulative cap across all claims, not a per-claim cap.

10.3 Non-excludable rights

Nothing in these Terms excludes or limits liability for legal rights that cannot be excluded or limited under applicable law.

10.4 Statutory limitation period

Any claim must be brought within the applicable statutory limitation period under Indian law.


11. Indemnity

You agree to indemnify, defend, and hold harmless Xieta, its directors, officers, employees, contractors, agents, affiliates, and successors from and against claims, losses, damages, liabilities, penalties, costs, and expenses, including reasonable legal fees, arising from or relating to:

(a) your use or misuse of the Service;

(b) your User Content;

(c) your breach of these Terms;

(d) your violation of applicable law;

(e) your infringement of third-party rights;

(f) your lack of authority to upload or process any document or personal data;

(g) claims by any person whose personal data, confidential information, or intellectual property appears in your User Content; or

(h) regulatory investigations, proceedings, penalties, or claims arising from your acts or omissions.

This indemnity does not apply to the extent a claim arises from Xieta’s own breach of law, wilful misconduct, or non-excludable legal obligations.


12. Privacy and Data Protection

Your use of the Service is governed by our Privacy Policy, which forms part of these Terms.

The Privacy Policy explains how we collect, use, share, retain, delete, and protect personal data, including how Auto-delete Mode, Private Mode, and System-Detected Private Mode work.

In case of conflict between these Terms and the Privacy Policy regarding personal data processing, the Privacy Policy will prevail to that extent.


13. Suspension and Termination

13.1 Suspension or termination by us

We may suspend, restrict, or terminate your access to the Service if:

(a) you violate these Terms or applicable law;

(b) we reasonably suspect fraud, abuse, unauthorised access, misuse, or security risk;

(c) required by law, court order, regulator, or government authority;

(d) your payment fails or remains unpaid;

(e) you upload prohibited or high-risk content;

(f) your use creates operational, legal, security, reputational, or third-party risk; or

(g) we discontinue or materially modify the Service.

Where practicable and lawful, we will provide notice. Immediate suspension or termination may occur where necessary for security, legal compliance, abuse prevention, or risk mitigation.

If we terminate a paid service for convenience and not due to your breach, fraud, misuse, non-payment, or legal requirement, we will provide a pro-rata refund or credit for the unused prepaid portion where applicable.

13.2 Termination by you

You may stop using the Service at any time. You may request account closure by using account controls where available or by contacting support@xieta.ai.

13.3 Effect of termination

Upon termination:

(a) your right to use the Service ends;

(b) we may delete or disable access to your account and associated data, subject to legal obligations and our Privacy Policy;

(c) scheduled deletion of documents under Auto-delete Mode, Private Mode, or System-Detected Private Mode will continue;

(d) standard-mode data may be retained or deleted as described in our Privacy Policy; and

14. Changes to These Terms

We may update these Terms from time to time.

For non-material changes, such as clarifications, updated contact details, formatting, or corrections, continued use after the effective date constitutes acceptance.

For material changes affecting fees, liability, data processing, user rights, or core service obligations, we will provide advance notice where required and may require affirmative acceptance before continued use.

Where a change materially affects how we process personal data, we will obtain fresh consent where required by applicable law.

If you do not accept material changes, you may stop using the Service and close your account.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of India.

Subject to any mandatory statutory rights or forums available under applicable law, the courts at Chandigarh, India will have jurisdiction over disputes arising from or relating to these Terms or the Service.

Nothing in this clause limits any right of a consumer to approach a competent consumer forum, statutory authority, regulator, or other forum having jurisdiction under applicable law.


17. Miscellaneous

17.1 Entire agreement

These Terms, the Privacy Policy, the Website Disclaimer, and any other policies or agreements expressly incorporated by reference constitute the entire agreement between you and Xieta regarding the Service.

17.2 Order of precedence

In case of conflict:

(a) the Privacy Policy prevails on personal data matters;

(b) these Terms prevail on commercial, contractual, and service-use matters; and

(c) the Website Disclaimer supplements both.

17.3 Severability
